These Terms and Conditions of Use, hereinafter the "T&Cs of Use", set out the rules applicable to the use of the website www.clecleboutique.com, of the personal areas and of the services offered by CLÉCLÉ, in particular My CLÉCLÉ Suite, the CLÉCLÉ Salon, the loyalty programme, the Cléclette and Very Important Cléclette statuses and the referral programme. Using these services implies that you have read and accepted these T&Cs of Use.
ARTICLE 1 — WEBSITE PUBLISHER
The website www.clecleboutique.com is published by: CLECLE, a simplified joint-stock company (SAS) with share capital of €5,000. Registered office: 231 rue Saint-Honoré, 75001 Paris, France. ARTICLE 2 — PURPOSE OF THE T&Cs OF USE
The purpose of these T&Cs of Use is in particular to govern:
- access to and use of the website www.clecleboutique.com;
- the creation and use of My CLÉCLÉ Suite;
- the features offered to members;
- the use of the CLÉCLÉ Salon;
- the publication and moderation of content;
- the operation of the CLÉCLÉ loyalty programme;
- the award and validity period of points;
- the Salon Guest, Cléclette and Very Important Cléclette statuses;
- the privileges associated with these statuses;
- as well as the referral programme reserved for Very Important Cléclettes.
Purchases made on the site are governed by the Terms and Conditions of Sale — T&Cs.
ARTICLE 3 — ACCESS TO THE SITE
Access to the website www.clecleboutique.com is free, subject to any interruptions necessary for its operation. Certain features are exclusively accessible to users with a personal My CLÉCLÉ Suite account. CLÉCLÉ endeavours to ensure the availability of the site but may temporarily suspend access to it, in particular for reasons of maintenance, security, updates or in the event of circumstances beyond its control.
ARTICLE 4 — CREATING MY CLÉCLÉ SUITE
Creating a CLÉCLÉ Suite is free. Depending on the features available, it allows the member in particular to:
- find and track their orders;
- save pieces in My Selection;
- view their Letterbox;
- access their personal information;
- view their points and privileges;
- follow their status within the CLÉCLÉ programme;
- access the referral programme where they hold Very Important Cléclette status;
- and enjoy the other features reserved for members.
When creating their account, the user undertakes to provide accurate, complete and up-to-date information. Each account is personal and may not be assigned or shared with a third party.
ARTICLE 5 — LOGIN DETAILS AND ACCOUNT SECURITY
The user is responsible for the confidentiality of the login details giving access to their CLÉCLÉ Suite. They are invited to use a sufficiently secure password and not to disclose it to a third party. Any suspicious or unauthorised use of their account must be reported as soon as possible to: bonjour@clecle.fr
CLÉCLÉ may implement the measures necessary to secure the account where a risk of fraud, unauthorised access or breach of security is identified. The security recommendations implemented on the site take into account the good practices applicable to online accounts and passwords.
ARTICLE 6 — DELETING MY SUITE
Members may request the closure of their CLÉCLÉ Suite from the features provided for this purpose or by writing to: bonjour@clecle.fr
Deleting the account results in the loss of access to its associated features, in particular to any privileges, points and invitations still available, subject to the legal obligations requiring CLÉCLÉ to retain certain information.
In particular, closing an account does not result in the deletion of data that CLÉCLÉ is required to keep under its accounting, tax or contractual obligations or in connection with the management of a possible dispute. The terms relating to personal data and to the exercise of the right to erasure are detailed in the Privacy Policy. The CNIL recommends in particular that a service should provide an account closure procedure and distinguish deletion of the account from the retention of data that remains necessary to comply with legal obligations.
THE CLÉCLÉ PROGRAMME
ARTICLE 7 — PARTICIPATION IN THE PROGRAMME
Creating a CLÉCLÉ Suite gives access to the Maison's loyalty programme. The programme is personal. The points, statuses, benefits and invitations associated with an account may not be sold, assigned or transferred to another person.
Orders placed without an account, as a guest customer, do not earn CLÉCLÉ points. An order placed without an account cannot subsequently be linked to a CLÉCLÉ Suite in order to obtain the corresponding points retroactively.
ARTICLE 8 — THE CLÉCLÉ STATUSES
The programme distinguishes three statuses.
Salon Guest
Anyone who has created a CLÉCLÉ Suite but has not yet placed a first definitively validated order benefits from the status of: SALON GUEST. This status is different from that of a customer making a purchase without an account.
Cléclette
The member becomes a Cléclette after their first order has been delivered, kept and definitively validated.
Very Important Cléclette — VIC
Very Important Cléclette status, or "VIC", is available when the member reaches the tier of 1,500 confirmed CLÉCLÉ points, subject to these T&Cs of Use.
Certain exceptional invitations or forms of recognition granted directly by the Maison may also give access to specific privileges where they are expressly presented as such.
ARTICLE 9 — AWARD OF POINTS
The general principle of the programme is: €1 spent = 1 CLÉCLÉ point.
Points linked to an order appear in My Suite and become definitively confirmed 21 days after delivery, provided that the order concerned has been kept and is not the subject of a refund cancelling all or part of its amount. Points are calculated on the value of the eligible products actually purchased, after any reductions have been applied. Delivery charges do not earn points.
The purchase of an e-gift card does not earn points. Using an e-gift card to buy a CLÉCLÉ creation does not, however, prevent the award of the points normally attached to the eligible product purchased. Points have no monetary value and cannot give rise to a cash refund.
ARTICLE 10 — POINTS BONUSES
In addition to points linked to purchases, CLÉCLÉ may award the following bonuses:
- First order: +100 points
- Second order: +150 points
- Third order: +250 points
- Birthday: +50 points
- Participation in certain eligible CLÉCLÉ events: +100 points
Bonuses linked to orders become final under the same conditions as the points attached to the corresponding order. The birthday bonus may be awarded once per twelve-month period where the date of birth required for it has been entered in My Suite. Where an event makes it possible to receive points, this information is stated by CLÉCLÉ before or at the time of the event.
ARTICLE 11 — RETURNS, CANCELLATIONS AND POINTS
Points corresponding to an order that is cancelled, fully refunded or returned before they are confirmed are not definitively awarded. In the event of a partial return, only the points corresponding to the products definitively kept remain acquired.
If points had already been confirmed before a refund or cancellation had to take place, CLÉCLÉ may adjust the balance in order to remove the points corresponding to the amounts refunded. This adjustment does not affect the Customer's legal rights relating to returns, guarantees or refunds.
ARTICLE 12 — VALIDITY PERIOD OF POINTS
CLÉCLÉ points are valid for a period of 24 months from the date they are confirmed. At the end of this period, points not used within the corresponding benefits expire automatically. Members may view their balance and their progress from the My Privileges section of My Suite.
ARTICLE 13 — TIERS AND PRIVILEGES
Progressing through the programme gives access to different tiers.
500 points — First Attention
From 500 confirmed points, the Cléclette gains access to the Maison's first level of privilege: First Attention. The nature of this gesture and any terms for using it are presented in My Suite when it is activated.
1,000 points — Atelier Privilege
From 1,000 confirmed points, the Cléclette gains access to the Atelier Privilege, including in particular an alterations benefit of up to €35 incl. VAT, according to the terms indicated in My Suite when it is used.
1,500 points — Very Important Cléclette
From 1,500 confirmed points, the Cléclette gains Very Important Cléclette — VIC status. Reaching the various tiers constitutes progression within the programme. The specific conditions for using a benefit are indicated to the member before it is activated.
ARTICLE 14 — VIC PRIVILEGES
Very Important Cléclette status gives access, depending on the operations offered by the Maison, to:
- early access of up to 24 hours before certain launches;
- invitations to certain events or appointments of the Maison;
- priority access to customer service and to certain requests;
- an alterations privilege of up to €50 incl. VAT, according to the terms communicated when it is activated;
- a birthday gesture;
- access to certain consultations, discussions or initiatives around the Maison's future creations;
- as well as the VIC referral programme.
Certain privileges depend on the availability of a service, an event or a particular operation and do not constitute a guarantee that a specific event or operation will be organised during any given period.
ARTICLE 15 — DURATION OF VIC STATUS
Very Important Cléclette status is granted for a period of 24 months from its activation. To renew their status at the end of this period, the VIC must have obtained at least 750 new confirmed points during her status period.
Where this condition is not met, the member keeps their CLÉCLÉ Suite and any Cléclette status, but loses access to the privileges exclusively reserved for VICs.
VIC REFERRAL PROGRAMME
ARTICLE 16 — ACCESS TO REFERRAL
The referral programme is exclusively reserved for members with active Very Important Cléclette status. Each VIC receives: 3 personal invitations per 12-month period. These invitations are available and viewable from the Referral programme section of My Suite. They are personal and may not be sold or offered publicly for commercial purposes.
ARTICLE 17 — THE REFERRED CUSTOMER'S BENEFIT
A VIC invitation allows an eligible new customer to receive: €40 off her first order of at least €350.
The invitation is valid for 30 days from its issue or its sending, according to the information displayed in My Suite. It is reserved for a person who has never yet placed an order with CLÉCLÉ. The benefit cannot be used to buy an e-gift card. Any refund of an order benefiting from the referral advantage is calculated on the amounts actually paid by the referred customer. The reduction granted cannot give rise to a cash refund.
ARTICLE 18 — THE REFERRER'S BENEFIT
When a referred customer validly uses her invitation and her first order is delivered, kept and definitively validated, the VIC who issued the invitation receives: +150 CLÉCLÉ points.
Points are therefore not awarded at the time of the order alone. In the event of a cancellation or return causing the order to lose its eligibility for the programme, referral points are not awarded or may be withdrawn where they had already been credited. After three successful referrals, an additional gesture may be reserved for the VIC by the Maison.
ARTICLE 19 — FAIR USE OF THE REFERRAL PROGRAMME
Referral is based on a personal recommendation made in good faith. The following are prohibited in particular:
- self-referral;
- the creation of multiple or fictitious accounts;
- the use of false identities;
- the artificial creation of orders for the sole purpose of obtaining points or benefits;
- the sale of an invitation;
- as well as any manipulation or fraud intended to circumvent the rules of the programme.
Where objective evidence suggests abuse or fraud, CLÉCLÉ may suspend the award of the points concerned for the time necessary to carry out checks. Where fraud is established, CLÉCLÉ may cancel the benefits fraudulently obtained and, where the seriousness or repetition of the facts justifies it, suspend access to the programme.
THE CLÉCLÉ SALON
ARTICLE 20 — PPRESENTATION OF THE SALON
The CLÉCLÉ Salon is a space allowing members of the Maison to share certain content and messages with the community. Depending on the features offered, a member may in particular send a text, a photograph or other content intended to be presented in the Salon. Sending content does not guarantee its publication.
ARTICLE 21 — PUBLICATION OF CONTENT
Content sent to the Salon is subject to validation by CLÉCLÉ before publication. CLÉCLÉ may in particular refuse to publish or may remove content where it:
- is manifestly unlawful;
- infringes the rights or dignity of a person;
- contains hateful, discriminatory, defamatory, threatening or harassing remarks;
- infringes the privacy of a third party;
- reproduces a photograph, a creation or any other content without the user holding the necessary rights;
- shows an identifiable person without, where necessary, that person's authorisation;
- contains personal information that it is not appropriate to make public;
- contains spam, commercial solicitation or advertising unrelated to the purpose of the Salon;
- contains a link or element likely to compromise the security of the site or of its users;
- or is manifestly unrelated to the purpose of the Salon.
The moderation rules and restrictions on content sent by users must be clearly set out in the terms of the service; the Digital Services Act also provides for transparency requirements concerning moderation decisions for the services to which those provisions apply.
ARTICLE 22 — RIGHTS OVER PUBLISHED CONTENT
The member retains the rights they hold in the content they send to the Salon. No general transfer of intellectual property to CLÉCLÉ takes place merely as a result of publication.
By submitting content for publication, the member grants CLÉCLÉ, free of charge and on a non-exclusive basis, the right to reproduce it, display it, adapt it to the technical constraints of display and make it available solely to the extent necessary for the operation and presentation of the Salon and of the CLÉCLÉ website. This authorisation is valid for the duration of the content's publication, plus the time strictly necessary for technical removal, backup or archiving operations where these are justified.
Any reuse of customer content by CLÉCLÉ for advertising purposes, on social networks or in a commercial campaign separate from the Salon will, where necessary, be subject to specific authorisation. The member warrants that they hold the necessary rights and authorisations concerning the content they send.
ARTICLE 23 — REMOVING CONTENT FROM THE SALON
A member may request the removal of one of their contents published in the Salon by contacting: bonjour@clecle.fr. CLÉCLÉ carries out the removal within a reasonable time, subject to any legal retention obligations. Removing content from the Salon does not necessarily entail the immediate deletion of all technical copies or data whose retention remains legally necessary.
ARTICLE 24 — REPORTING CONTENT
Anyone who considers that content available in the Salon is unlawful or infringes their rights may report it to CLÉCLÉ. The report must make it possible to identify the content concerned precisely and explain the reason for the report. It may be made from the feature: REPORT THIS CONTENT where it is available beneath the publication concerned, or electronically at: bonjour@clecle.fr
The reporting mechanism must be easily accessible and make it possible to identify precisely the content and the ground invoked. This principle corresponds in particular to the notification mechanism provided for in Article 16 of the Digital Services Act for the hosting services concerned.
ARTICLE 25 — MODERATION AND APPEALS
CLÉCLÉ reviews content and reports in a manner proportionate to the nature of the Salon and to these T&Cs of Use. Where content already published is removed or made inaccessible for failing to comply with these rules, its author may be informed of the reason for that decision where their electronic contact details are known and where the applicable regulations require it.
A member wishing to contest a decision concerning their content may write to: bonjour@clecle.fr, stating the subject: "Appeal — Salon moderation". CLÉCLÉ then re-examines the request and may uphold or amend its decision. The DSA provides in particular that content restrictions must be described in the terms of the service and that removal decisions falling within its scope must be accompanied by a clear statement of reasons.
GENERAL USE OF THE SERVICES
ARTICLE 26 — PROHIBITED BEHAVIOUR
The user undertakes to use the CLÉCLÉ services in good faith and in accordance with their purpose. It is prohibited in particular to attempt to access an account or a protected part of the site fraudulently, to interfere with the operation of the site, to circumvent security systems, to extract data on a large scale, to impersonate a third party or to use the services for an unlawful purpose.
ARTICLE 27 — SUSPENSION OR RESTRICTION OF AN ACCOUNT
CLÉCLÉ may restrict or suspend certain features where a user:
- compromises the security of the site;
- commits proven fraud;
- misuses the loyalty or referral programme;
- repeatedly publishes manifestly unlawful content;
- or seriously or repeatedly breaches these T&Cs of Use.
The measures taken must be appropriate to the seriousness and frequency of the facts observed. Except in cases of urgency, fraud, security risk or a legal obligation requiring immediate action, CLÉCLÉ favours a prior warning where the situation can reasonably be remedied. Suspending an account may not have the effect of depriving the Customer of their legal rights relating to orders already placed.
ARTICLE 28 — INTELLECTUAL PROPERTY
The website www.clecleboutique.com, its visual identity and the texts, photographs, illustrations, drawings, creations, trademarks, logos, videos and other elements that make it up are protected by the applicable intellectual property rights. They belong to CLECLE or are used with the authorisation of their owners. Accessing the site or creating an account does not confer on the user any ownership rights over these elements.
ARTICLE 29 — PERSONAL DATA
Using My Suite, the loyalty programme, the referral programme and the Salon may involve the processing of personal data. The terms of this processing are explained in the: PRIVACY POLICY, accessible from the site. CLÉCLÉ applies in particular the principle of collecting only data that is adequate, relevant and necessary in view of the purposes pursued.
ARTICLE 30 — CHANGES TO THE SERVICES AND TO THE PROGRAMME
CLÉCLÉ may change the features of its site and of My Suite as well as the terms of its programme, in particular in order to improve them, to adapt them to the evolution of the Maison or to comply with a regulatory change.
Substantial modifications to these T&Cs of Use are brought to the attention of the users concerned in an appropriate manner before they come into force where notice is required. Where CLÉCLÉ decides to substantially modify or to end the loyalty programme, members are informed within a reasonable time so as to allow them, where applicable, to use the benefits already confirmed under the conditions communicated. This possibility of modification does not allow CLÉCLÉ to arbitrarily remove rights mandatorily granted to consumers. Clauses creating a significant imbalance to the detriment of the consumer are prohibited by the French Consumer Code.
ARTICLE 31 — LIABILITY
CLÉCLÉ endeavours to ensure the operation and security of its services. It cannot, however, guarantee permanent and uninterrupted availability of the site, in particular in the event of maintenance, a technical incident or circumstances beyond its control. No provision of these T&Cs of Use has the purpose or effect of excluding liability that cannot lawfully be excluded or of limiting a consumer's mandatory rights.
ARTICLE 32 — GOVERNING LAW
These T&Cs of Use are governed by French law. Where a user is a consumer residing in another Member State of the European Union, this designation of French law does not deprive them of the mandatory protective provisions from which they benefit under the applicable legislation. In the event of a dispute, the user is invited to contact CLÉCLÉ beforehand at: bonjour@clecle.fr in order to seek an amicable solution.
ARTICLE 33 — ENTRY INTO FORCE AND AMENDMENT OF THE T&Cs OF USE
These T&Cs of Use come into force from their publication on the site. The applicable version is the one available on www.clecleboutique.com on the date the service concerned is used. Any substantial modification likely to affect the rights or obligations of members is brought to their attention in an appropriate manner.
